Terms of Service
ExpressHosting, “The Company”, agrees to provide services to the Subscriber, subject to the following Terms of Service (TOS).
We have the responsibility to protect each client and provide them with the best services available. Please read the following guidelines very carefully before ordering our services.
1) Law Enforcement Disclosure
Use of the subscriber’s service for any illegal activity is strictly prohibited. Therefore, Subscriber agrees that the Company may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition the Company shall have the right to terminate all service set forth in this Agreement.
2) Rates of Service
The Company reserves the right to alter the Subscribers agreed upon rate from time to time in order to maintain a cost effective rate of service.
3) SPAM and Unsolicited Commercial Email (UCE)
The Company takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of may not use or permit others to use our network to transact in UCE. Customers of may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. In addition, it is not acceptable to transmit bulk email through remote SOCKS, HTTP or other similar proxies who in turn make a SMTP (TCP port 25) connection to the destination mail servers. This technique may result in account suspension or termination. Violations of this policy carry severe penalties, including termination of service. In order to prevent unnecessary blacklisting due to spam we reserve the right to occasionally sample bulk email being sent from servers.
Customers hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove ANY and ALL traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been COMPLETELY removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation WILL be immediately and permanently removed from our network without notice.
4) Other Prohibited Actions
Any attempt to undermine or cause harm to any server, or customer, of the company is strictly prohibited. Operation of IRC servers or IRC bots on our servers will result in an immediate suspension of service.
5) Access to Other Computers or Networks
Customer shall neither allow, nor participate in the illegal or unauthorized accessing (often known as “hacking” or “cracking”) of computers or networks operated and/or maintained by the company. Customer shall not use our systems to engage in illegal activities including, but not limited to breaking into remote systems, credit card fraud, theft, vandalism, threats, or violence. These unacceptable uses carry potential civil and criminal penalties under both federal laws and the laws of most states and may constitute grounds for immediate termination.
6) System and Network Security
Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples of system or network security violations include, without limitation, the following:
- Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
- Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
- Interference with Service to any user, host or network including, without limitation, electronic junk mailing, flooding, or deliberate attempts to overload a system and broadcast attacks, forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting.
Under no circumstances shall the company be responsible for the loss of any customer data from our servers. Possible reasons for loss of data may include external or internal attacks against our servers or network, hardware failure, user error, network failure, forces of nature and administrative error. Customers are responsible for the data on their servers. In the event that a hard drive failure occurs, the company will attempt a best effort to provide access to that data if possible. We encourage each customer to make regular backups of their data.
Under no circumstances, including negligence, shall the company (or anyone else involved in administering or distributing the services of the company) be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of (or inability to use) the company’s services; software, including but not limited to reliance on any information obtained, or stored, on the company servers; or that result from mistakes, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of god, communications failure, theft, destruction, or unauthorized access to the company’s records, programs, or services.
In addition, under no circumstances shall the company be held liable for the errors (defined by us) made by our billing agents.
All services made available by the company are provided on an “AS IS” and “BEST EFFORT” basis.
8) Account Termination Grounds
If any terms or conditions in this document are breached it shall be deemed grounds for account deactivation.
We reserve the right to terminate any account without prior notice. If we deactivate your account for violating this policy, your will forfeit your rights to any refunds and none will be given. Our normal policy is a warning first and if the offense continues, the account deactivation without any further warnings.
If you wish to cancel service you receive from us, you can do so at any time without any further obligations. All cancelations are required 30 days in advance and no more than 60 days prior written notice and sent to:

10) Denial of Service
We reserve the right to refuse service to anyone at any time for any reason
